Frederick however contended that as the extra days had not been agreed Tarrant was in breach of his agreement and he had allegedly already lost 20-30 customers due to complaints about Tarrant. The case revolved around whether Frederick had advised Tarrant to be back by Saturday as that was a busy day or whether Tarrant's mother had written in April to get the extra days (though this according to Frederick was never confirmed). Once Tarrant was on leave, his father wrote thanking Frederick and was advised that the extra days had not been agreed. Frederick's uncle Alfred Frederick Way confirmed that he had told Tarrant to be back by Saturday. He also testified that Tarrant had appropriated money, broken things, lost him customers by splashing their clothes with soap and also often appeared to have been sleeping on the sofa when Frederick was out of the shop.
