Last Will and Testament of James Henry Hann (1878-1967)

This is the last Will and Testament
of me JAMES HENRY HANN of Salisbury Villas Rownhams in the County of Hants
1. I HEREBY revoke all former testamentary dispositions made by me
2. I APPOINT my Son EDMUND PHILIP HANN of Salisbury Villas Rownhams aforesaid to be the
sole executor of this my Will
3. IF my Wife EMMA HANN shall survive me for a period of one month I devise and
bequeath all my assets of whatsoever kind and wheresoever situate to my Wife absolutely
and without any sort of trust or obligation
4. IF my said Wife shall predecease me or shall not survive me for the period aforesaid
I direct that Clause 3 hereof shall not take effect and this my Will shall be contrued
and take effect as if the said Clause 3 had been wholly omitted herefrom and that the
following clauses of this my Will shall have effect
5. IN so far as may be necessary and for the avoidance of doubt I direct that if my
Wife shall survive me for a period of less than one month then the income of my estate
accruing from the date of my death until the date of the death of my said Wife shall be
accumulated and form part of my residuary estate
6. I DEVISE AND BEQUEATH unto my Executor all my real and personal estate and effects
whatsoever and wheresoever upon trust to sell call in and convert the sum into money with
power to postpone the sale calling in and conversion thereof so long as he shall in his
absolute discretion think fit without being liable for loss
7. MY Executor shall hold the net proceeds of the said sale and conversion and my ready
money upon the following trusts:-
(a) Upon trust to pay thereout all my just debta and funeral and testamentary expenses
(b) Subject thereto upon trust for my four Sons namely Charles Harry Hann, Edmund Philip Hann,
Arthur John Hann and Ralph Eric Gordon Hann in equal shares or to the survivors or
survivor of them absolutely
8. PROVIDED that if any child of mine shall die in my lifetime leaving issue living at my
death such issue if and when they attain the age of twenty-one years or marry under that age
shall take by substitution and if more than one in equal shares per stirpes the share of my
estate which such deceased child of mine would have taken if he had survived me but so that
no issue shall take whose parent is alive at the date of my death and so capable of taking
9. I APPROVE of Messrs. Wilfred Light & Reid of 81 Shirley High Street Southampton aforesaid
acting as solicitors with the administration of my estate
