Transcription of the will of John Guy (PROB11/2196-87)

This is the last Will and Testament
of me John Guy of Beaminster in the County of Dorset Steerman I give and
devise to my daughter Elizabeth Charity Chard Wife of David Chard all that
dwellinghouse with the appurtenances late in the ownership of Robert Watts
and now divided into four Dwellings situate at or near a place called Gerrards
Green in the Parish of Beaminster aforesaid and in the respective occupancies
of Thomas Loveridge Joseph Slade Mary Tuck and Jeremiah Bartlett and
which said premises interest and other moneys secured to me on Mortgage
thereof To hold the same premises and moneys respectively unto the said
Elizabeth Charity Chard her heirs executors administrators and assigns for all
my estate right and interest therein I give to my daughter Mary Guy my
clock which is kept above stairs the Feather Bed on which she sleeps and
the bed linen bedstead and furniture thereto belonging to my daughter Susan
Guy the feather bed on which she sleeps with the bed linen bedstead and furniture
thereto belonging And I give to my dear Wife Susannah Guy during herlife
the use of the Feather Bed on which I sleep with the Bedstead and furniture
thereto belonging and after her decease I givethe last mentioned Bed Bedstead
and Furniture to my daughter Hannah Guy I give all the remainder of my
household goods and furniture plate linen and china and all my wearing
apparel to my said Wife I direct my Executors hereinafter named to determine
by due notice or ortherwise at the earliest possible period after my decease that
Tenancy as my Representatives of the Farm called Stonecombe Farm situate
in the Parsh of Beaminster aforesaid which I rent of George Berkely
Maxwell Esquire and whereon my son in law Samuel Bugler and his
Wife my daughter Ann Bugler now reside And I direct that until such
determination of the said Tenancy my said Executors shall permit the said
Samuel Bugler as their Agent to carry on the Farming Business on the
said Farm with the stock and effects which at the time of my decease may be
thereon except such of my girses as are hereinafter disposed of and I direct that
the prceeds of the said farm and of the said stock as the same may from time
too time be disposed of shall be applied in discharge of the rent which may be due
at my decease or which may thereafter accrue due for the said Farm up to the
determination of the Tenancy of my said Executors therein Provided always
and I authorize my said Executors to remove the said Samuel Bugler from
the said Agency at any time if they shall think proper and subject to the payment
of the said rent I direct that my said Executors shall stand possessed of thel
ive and dead farming stock and effects which at the time of my decease
may be on the said Farm and the profits and proceeds of the said farm
and stock except thge horses hereinafter disposed of and also except the Sheep
thereon and the profits and proceeds of the sale or dispostionof the said
Sheep Upon trust for my said daughter Ann Bugler And I direct that at
the expiration of the said Tenancy or in case the said George Berekley
Maxwell shall accept the said Samuel Bugler as Tenant of the said Farm
and when and as soon as the said rent shall have been fully satisfiedor
said Executors shall have been exonerated from all liability in respect of the
said rent my siad Executors shall give up the possessionof so much of the
said Farming stock and effects as may then be remainingundisposed of on the
said Farm except as before excepted unto the said Ann Bugler And I direct that
my ??? Black horse and Black Mare shall be deemed as part of the Stock on
the said Farm I give my brown horse called Bob to my son James Guy
And I direct that my other horses shall be considered as part of my residuary
personal estate hereinafter disposed of I give and bequeath all the residue and
remainder of my farming stock goods chattels moneys and Personal Estate
and Effects unto my brother Daniel Guy of Nethebury in the County of Dorset
Butcher and my friend Daniel Bowditch of Misterton in the County of
Somerset Yeoman Upon trust that they or the survivor of them or the
excutors or administrators of cuch survivor do and shall as soon asconveniently
may be after my decease sell call in collect and convert the same into money
with full power to effect such sale either by auction of private contract and do
and shall thereout pay and discharge my sebtsand huneral and testamentary
expenses and pay my said Wife the sum of ten pounds to my said sonJames
Guy the sum of nineteen pounds and nineteen shillings to my grandson John
Dunham Pitcher nineteen pounds and nineteen shillings and do and shall pay and
divide the residue of the moneys to arise for the sale collection and conversion
or forming part of my said residuary personal estate unto and equally amongst
,y said son James Guy and my daughters Sarah Roberts Wife of John
Roberts Elizabeth Charity Chard Wife of David Chard Susan Guy and Hannah
Guy share and share alike And I appoint the said Daniel Guy and Daniel
Bowditch Executors of this my Will And I direct and decalre that they
shall not be answerable or accountable for more moneys or effects than shall
actually come to their hands by virtue of this my Will nor for any loss
or misfortune which may happen of or to the said trust moneys or trust
estate by reason of the failure or default of the said Samuel Bugler or any
other person with whom or in whose hands the same or any part therof
may be entrusted in the performance of the intents and purposes of this my
Will or by any other means not happening or being occasioned by or through
the wilful neglec or default of the said Executors and that they shall not be
answerable or accountable for each othernotwithstanding their joining in giving
or signing any receipt for the sake of conformity but each of them for his own
acts receipts neglects and defaults only and that it shall be lawful for them
to retain and allow to each other out of the said trust moneys their costs
and expenses in the execution of teh trusts and purposes of this my Will or
in anywise incident thereto In witness whereof I have hereunto set my hand
this eleventh day of March in the year of our Lord One thousand eight
