Transcription of the will of William Frampton (PROB11/1761)

This is the Last Will & Testament
of me William Frampton of Beaminster in the County of Dorset Builder I
give and bequeath unto my dear wife Mary from and out of my Copyhold
hereditaments personal Estate and Effects herinafter bequeathed to my Son
John Purchase Frampton one annuity or clear yearly Sum of Forty pounds Sterling
to be paid to her yearly and every year for and during the term of her natural life
by even and quarterly payments the first payment thereof to begin and be made
at the end of three Calendar months next after my deceasealso I give and
bequaeth unto my daughter Mary Ann Frampton the Sum of Three hundred
pounds Sterling to be paid to her by my Executorhereinafter named withinsix
Calendar months next after the decease of my said wife but to be a vested
Interest in and transferrable by my said daughter immediately after my decease
also I give and devise Subject as hereinafter mentioned untomy daughter
Jane Styfield Frampton all that half Tenement with itsappurtenances situate
in East street in Beaminster aforesaid containinga Dwellinghouse lately erected
thereon together with the yardGarden and orchard thereunto belonging formerly in the
possesion of Mary Cox deceased afterwards of Benjamin Stacey also deceased late of
William Clift and Rebecca his Wife but now of mettthe said William Frampton together
with all ways paths passages waters watercourses profits commodities advantages and
appurtenances whatsoever to the said premises belongingor in anywise appertaining
all which said premisesI have surrendered to the use of this my Will To hold the
same with the appurtenances unto my said daughter Jane Styfield for the term of
her life and of her assigns for ever according to the custom of the said Manor under
the yearly rents duties and services of right due and accustomed to the Lord of the said
Manor for the same also I give and devise (subject to the said annuity or yearly rent
xharge of Forty pounds hereinbefore bequeathed to my said Wife and also subject as
hereinafter mentioned) unto my said Son John Purchase Frampton all that Messuage
or Dwellinghouse two Gardens orchard workshops stable outhouses and premises situate
lying and being in East Street in Beaminster aforesaid and parts or parcels of the Manor
of Beaminster Prima aforesaid formerly in the tenure of John Bewsey afterwards of
William Silke since of George Silke late of James Brown and Hannah Oke but now of
me the said William Frampton together with all houses outhouses Edifices buildings
ways paths passages waters watercourses casements profits commodities advantages and appurtenances
whatsoever to the said Messuage or dwellinghouse gardens orchard workshops stable
and premises belonging or in anywise appertaining all which said premises I have
surrendered to the use of this my Will To hold the same with the appurtenances unto
my said Son John Purchase Frampton for the term of his life and of his assigns for
ever according to the Custom of the said Manor under the yearly Rents duties and services
of right due and accustomed to the Lord of the said Manor for the same provided
nevertheless and the above devised to my said Daughter Jane Styfield and my said
Son John Purcase Frampton are made upon this express condition that it shall and may
be lawful for my said dear Wife for andduring the term of her natural life if she
shall continue my Widow but no longer and also to and for my said Daughters
ducring such the lifetime of my said Wife if they my said Daughters or either of them
shall continue unmarried but not otherwiseto use and occupy the Dwellinghouse
Gardens and orchard only hereinbefore devised to my said Son John Purchase for and during
as long time as the said DwellinghouseGardens and orchard hereinbefore devised to
him shall be occupied by my said Wife Daughters or either of them to use and occupy
all and singular the premises hereinbefore devised to my said Daughter Jane Slyfield It
being my wish that my said Wifeand Daughters shouldlive and inhabit together in
the house where we now dwell until either of the events which I have referred to in this
proviso shall take place and that in the meantime my said Son John Purchase should
continue to occupy the premises where he nowlives so as the better to enable him to carry
on the business which he and myself now follow also I give and bequeath unto my said
dear Wife all and singular my household Goods ad furniturein use books plate Linen
and China and household Stuff of every description to be by her nevertheless used and
enjoyed for the term of her life only or second Marriage as aforesaid and from and after
her decease or second marriage I give and bequeaththe same unto my said two Daughters
equally to be divided between them for their own proper use and benefit also I give and
bequeath to my said Son John Purchase Frampton all my Wearing apparel of every
description and also my Watch and Chain I usually wear therewith and wheras I have
lately insured my life in the West of England Life Insurance office in the Sum of Two
hundred pounds which will become paytable immediately after my decease Now I do
hereby give and bequeath the policy on which such Insurance is effected and all my
Estate and Interest therein unto my said Son John Purchase Upon Trust nevertheless
that ,y said Son do and shall as soon as conveniently may be after my decease
call in and compell payment of the same and I do declare that his receipt shall be
a suffiecient discharge to the Directors of the said office or other person paying the same
who shall not be obliged to see to the application thereof and upon trust immediately after
the receipt of the same Sum to apply as much thereof as shall be necessary in discharging
the principal Sum of one hundred and fifty pounds which I owe on Mortgage oif the
said hereditaments hereinbefore devised to my said Son together with all Interest which
shall be then due thereon and all costs attending the Transfer of such Mortgage and so
shall in the next place pay over the residue of the said Sum of Two hundred piounds unto
my said dear Wife for her own absolute use and benefit and all the rest residue and
remainder of my Goods and Chattels personal and Testamentary Estate and Effects
whatsoever and wheresoevereand all my monies and securities for money book and
other debts and also all my Stock in Trade amd working utensils Subject nevertheless
to and charges and chargeablewith the payment in common with the said Copyhold
hereditaments hereinbefore devised to my said Son of the said annuity or yearly Rent
charge of Forty pounds hereinbefore given to my said Wife and also to and with the
payment of the said legacy or sum of three hundred pounds hereinbefore bequeathed to
my said daughter Mary Ann Frampton and of all other my just debts funeral and
testamentary charges and expenses and wherewith I charge and oblige the same
accordingly I gaive and bequeath unto my said Son John Purchase Frampton his
executors administrators and assigns according to the different natures and qualities of the
same? respectively and I appoint the said John Purchase Frampton sole Executor
of this my Will heeby revoking all others by me at any time heretofore madeand do
declare this to be my last Will and Testament In Witness whereof I the said William
Frampton the Testaor have to this my last Will and Testament contained in three
sheets of paper to the first two sheets thereof subscribed my name and to this third and
last sheet sunscribed my name and affixed my seal this thirteenth day of October in the
year of our Lord one thousand eight hundred and twenty eight Wm. Frampton

for and to be his last Will and Testament in the presence pf us who at his request in his
presence and in the presence of each other have hereunto subscribed our names as

This is a Codicil to the last Will and Testament of me
William Frampton of Beaminster in the County of Dorset Biiulder which Will
bears date the thirteenth day of October on thousand eight hundred and twenty
eight Whereas I have in and by my said Will given and bequeathed unto my
dear Wife Mary from and out of my Copyhold hereditaments personal Estate and
yearly Sum of Forty pounds Sterling to be paid to her yearly and every year for and
during the term of her natural life by even and quarterly paymentsthe first payment
thereof to begin and be made at the end of three Calendar months next after my
decease Now I hereby revoke the said device contained in my said Will toor in
favour of my said Wife and in lieu thereof I do give and bequeath to her from and
out of my Copyhold hereditaments personal Estate and Effects in and by my said Will
bequeathed to my said Son John Purchase Frampton one annuity or clear yearly
Sum of Thirty pounds Sterling to be paid to her yearly and every year for and during
the term of her natural life is she shall so long continue my Widow and unmarried the
first payment thereof to begin and be made at the end of three Calendar months next
after my decease provided nevertheless that immediately after the decease or second
marriage of my said Wife the said annuity shall cease and detrmine and in case
the same shall cease and determine by the second marriage of my said Wife I give
and bequeath unto each of my two Daughters one annuity or clear yearly Sum of
Ten pounds Sterling to be respectively paid to them yearly and every year by my said
Son John Purchase Frampton for and during as long time as they shall respectively
remain unmarried the first payment of such respective annuities of Ten pounds each
to commence and be payable to each of my daid daughters at the end of three calendar
months next after the second marriage of my said dear Wife provided nevertheless
that immediately after the decease or marriage of my said daughters respectively
the said annuities shall respectively cease and determine and I hereby ratify and
confirm my said Will in every respect except so far as the same is hereby revoked In
Witness whereof I have hereunto subscribed my name and affixed my seal the
twenty third day of July one thousand eight hundred and twenty nine W Frampton
