Dr Hann's Trust.

In his will Dr Henry Fred Hann left what amounted to £8500 (after the death of his wife in 1949) to the Lord Mayor, ALdermen and Citizens of Portsmouth who in their capacity as Education Authoriy were to provide either further education at a university or university college to suitable persons or if nobody suitable for this to suitable persons to enter a profession that would bring credit to their school or the town. Thomas Scott Foster, the sole trustee, was challenged by TK Wigan for the next of kin on the basis that the second part of the gift was not legally charitable and therefore the 'gift' failed it not being clear how much should be applied for the charitable or non-charitable object. The judge ruled that the gift had failed and ruled that the estate be held in trust for the next of kin
