Transcription of an indenture dated 8 Sep 1774 (Dorset Record Office: D/FCC 34)

"This Indenture made the Eighth Day of September in the Year of our Lord One Thousand Seven Hundred and Seventy four Between William Hann of Stoke Abbotts in the County of Dorset Miller and Mary his Wife late Mary Taylor Widow formerly Mary Hill one of the Daughters and Coheirs of the Body of John Hill the Younger of Stoke Abbotts aforesaid Yeoman deceased begotten on the Body of Deanes his wife also deceased formerly Deanes Staples and also Coheir with her Sister Jane the Wife of Samuel Warren to the said John Hill of the one part and Ann Brickell late of Dorchester in the County of Dorset but now of Beaminster in the County of Dorset Widow of the other part Whereas by Indenture of Three parts bearing date the Tenth Day of February in the Year of our Lord One Thousand Seven Hundred and Sixty Six and made or mentioned to be made between the said Mary Hann the Wife of the said William Hann then called Mary Taylor of Bridport in the County of Dorset Widow only surviving Child and Heir of the Body of John Hill the Younger late of Stoke Abbotts in the said County of Dorset Yeoman deceased begotten on the Body of Deanes his Wife also deceased formerly Deanes Staple And also right Heir of the said John Hill the Younger of the first part Henry Smith of Stoke Abbotts aforesaid Gentleman of the second part and the said Ann Brickell of the third part The said Mary Taylor for the considerations therein mentioned did demise grant bargain and sell unto the said Ann Brickell her Ex(ecut)ors Adm(inistrat)ors and Assigns All that Dwellinghouse Garden and Backside thereunto belonging and adjoining with the Appurtenances situate lying and being in Stoke Abbotts aforesaid then late in the possesion of him the said John Hill the Younger deceased bounded on the South East with the Land of John Biddlecombe and on the West with the Lands belonging to the parsonage of Stoke Abbotts aforesaid and the Kings Highway on the East And also all that Close or parcell of Downe Ground called or known by the name of the Downe abbutting upon the Lane called Lewson Hill Lane on the South and the Ground formerly of Benjamin Studley on the North containing by Estimation One Acre and half be the same more or less lying and being in Stoke Abbotts aforesaid lately in the Tenure of one Henry Clark but then of the said Mary Taylor her Tennants or Assigns together with all Ways paths passages Easements Waters Watercourses Wateringplaces Profits commodities and Appurtenances to the same premises belonging or in any wise appurtaining And also all that Close of pasture or Furzey Ground commonly called and known by the name of Downe [No. 243 on the tithe map?] containing by Estimation Six acres (be the same more or less) situate lying and being in the parish of Stoke Abbotts aforesaid and abbutting on the East Side against the Road or Way that leadeth towards Bridport And also all that Close of Meadow or pasture Ground commonly called Little Close containing by Estimation Four acres (be the same more or less) lying and being within the parish of Stoke Abbotts aforesaid and then or late part or parcell of and Estate there called Lawsley formerly in the possession of Hugh Crabb deceased and late in the possession of John Moore and then in possession of the said Mary Taylor or her Assigns and then or late part or parcell of then or late Manor or reputed Manor of Stoke Abbotts and Charterhay in the said County of Dorset And also all that Hedge seperating and dividing the said Close called Little Close from another Close called Eight Acres also of the said Estate called Lawsley And also all Edifices Buildings Barns Stables Stalls Courts Yards Curtilages Gardens Orchards Lands Meadows Pastures Woods Underwoods Ways Paths Passages Easements profits Commodities Water Watercourses Emoluments Advantages Hereditaments and Appurtenances whatsoever to the said premises or any part or parcell thereof belonging or in any wise appurtaining And also the Estate Right Title Interest property claim and demand whatsoever of her the said Mary Taylor of in or to the said premises every or any part or parcell thereof To be had and holden unto the said Ann Brickell her Ex(ecut)ors Administrators and Assigns from thenceforth for by and during and unto the full end and Term of One Thousand Years from thence ......... and fully to be compleat and ended at and under the rent of a Peper corn if demanded and subject to a proviso therein contained that if the said Mary Taylor her Heirs Ex(ecut)ors Adm(inistrat)ors or Assigns did and should well and truly pay or cause to be paid unto the said Ann Brickell her Ex(ecut)ors Adm(inistrat)ors or Assigns the full sum of forty pounds of good and lawful Money of Great Britain with Interest for the same at and after the Rate of Four Pounds for One Hundred pounds for a year and upon the Tenth Day of August next ensuing the date thereof without any deduction or Abatement whatsoever that then the said term of One Thousand years should cease and determine any Thing therein contained to the contrary thereof in any wise notwithstanding And Whereas in and by one other Indenture of Three parts and made between the said William Hann and Mary his Wife of the first part James Burt of Hatchland within the Parish of Netherbury in the said County of Dorset Surgeon of the second part and the said Ann Brickell of the third part after reciting as hereinbefore is recited or to that Effect And also reciting that Jane Hill then the Wife of Samuel Warren of Bridport in the County of Dorset Innholder the daughter of the said John Hill the Younger by the said Deanes Staple being living although at the Time of making and executing the said Indenture of Mortgage was supposed to be dead only an undivided Moiety of the said Dwellinghouse Garden and Backside Closes Lands and premises passed to the said Ann Brickell by the said recited Indenture of Mortgage and no more than one undivided Moiety thereof was then liable to the said forty pounds and Interest secured thereon and also reciting that since making and executing the said recited Indenture of Mortgage the said Mary Taylor was intermarried with the said William Hann and the said principle sum of forty pounds still remained due and owing."
