Transcription of an indenture dated on 18 Feb 1772 (Dorset Record Office: D/FFO NG34)

"Owing on the said recited Indentiture of Mortgage and premisses thereby granted but all Interest was paid and discharged to the date thereof And also reciting that the said William Hann and Mary his Wife having occasion to borrow and take up at Interest the further Sum of Fifty pounds the said Ann Brickell had at their Request that day lent and advanced them the same on the credit and Security of the said recited premisses and on a further Mortgage thereof The said Indenture now in recital did Witness that the said William Hann and Mary his Wife did in and by the said Indenture now in recital charge the said Marys Moiety of the said premisses with the payment of the further sum of Fifty pounds with Interest for the same at the rate of Four pounds for One Hundred pounds for a Year as in and by the said recited Indentures relation being thereunto had will more fully appear And Whereas the said William Hann and Mary his Wife have at the date hereof applied to the said Ann Brickell to advance and lend them the further Sum of Thirty pounds on the said recited premisses and on an additional Mortgage thereof which the said Ann Brickell hath agreed to do Now this Indentiture Witnesseth that for and in consideration of the Sum of Thirty pounds of good and lawfull Money of Great Britain to the said William Hann and Mary his Wife in hand paid by the said Ann Brickell at or before the sealing and delivery hereof the Receipt whereof is hereby acknowledged and hereon indorsed They the said William Hann and Mary his Wife do for themselves their Heirs Exors and Admors covenant grant declare consent and agree to and with the said Ann Brickell her Exors Admors and Assigns by these presents that the said Marys undivided Moiety of the said Dwellinghouse Garden Backside Close Lands and premisses with their appurtenances and which passed to the said Ann Brickell in and by the said recited Indenture of Mortgage shall from henceforth and from Time to Time and at all Times hereafter stand charged and chargeable with and be a Security as well for the payment and Repayment of the said Sum of Thirty pounds now advanced and lent by the said Ann Brickell to the said William Hann and Mary his Wife as also with the payment of the said respective sums of Forty pounds and Fifty pounds already advanced and lent and now due thereon as aforesaid making in the whole the Sum of One Hundred and Twenty pounds together with the Interest for the said respective Sums from the date hereof at and after the Rate of Four pounds for One Hundred pounds for a Year And also that the said Ann Brickell her Exors Admors or Assigns shall not be compelled or compellable in Law or Equity to surrender or deliver up the said recited Indentures of Mortgage or either of them or or to surrender or reconvey the said undivided Moiety of the said premisses hereinbefore mentioned, and recited or any part thereof unto the said William Hann and Mary his Wife or to either of them or to their Heirs or Assigns or either of them or unto any other person or persons whatsoever untill as well the said respective Sums of Forty pounds and Fifty pounds already due on the said premisses as the said Sum of Thirty pounds now lent thereon make together the said Sum of One Hundred and Twenty pounds and all Interest to grow due for the same respective Sums and all such reasonable Costs and charges as the said Ann Brickell her Exors Admors or Assigns shall or may be put unto in respect thereof shall be fully repaid and satisfied to the said Ann Brickell her Exors Admors and Assigns any Thing in the said recited Indentures or either of them contained to the contrary thereof in any wise notwithstanding And Whereas the said William Hann and Mary his Wife did in Michas Term which was in the Year of our Lord One Thousand Seven Hundred and Seventy two acknowledge and levy in due form of Law before his Majesty's Justices of the Court of Common Pleas at Westminster unto the said James Burt and his Heirs one 'Fine Sur Conizance de droit come ceo xt' in conjunction with other Lands of the said undivided Moiety of the said Dwellinghouse Garden Backside Closes Lands and premisses hereinbefore mentioned and recited The uses of which said Fine were by the said last recited Indenture of Mortgage of the Eighteenth of February One Thousand Seven Hundred and Seventy two declared to be To the Use in the first place of the said Ann Brickell her Exors Admors and Assigns for the Remainder of the said Term of One Thousand years and payment and satisfaction of the said respective Sums making together the Sum of Ninety pounds and all Interest due for the Same and Subject hereto to such Uses Intents and purposes as the said William Hann and Mary his Wife by any Deed or Writing Deeds or Writings by them duly executed in the presence of Two or more credible Witnesses should direct limit convey and appoint Now this Indenture further Witnesseth that for the effectual securing the Repayment as well of the said Sum of Ninety pounds already due and owing on the said premisses as of the said Marys undivided Moiety of the said Closes Lands annd premisses it is hereby declared and agreed by and between the said parties to these presents and the true Intent and meaning hereof is and is hereby declared to be and the said William Hann and Mary his wife for themselves their Heirs Exors Admors and Assigns do covenant consent declare and agree to and with the said Ann Brickell her Heir Exors Admors and Assigns and the said William Hann and Mary his Wife by this Deed or Writing by them duly executed in the presence of Two credible Witnesses do hereby limit and appoint that the said Fine so as aforesaid levied on the said premises to the said James Burt and his Heirs by the said William Hann and Mary his Wife by whatsoever name or description levied or ascertained and all and avery other Fine or Fines already had made done or levied or hereafter to be had made done or levied of the said Lands and premisses by and between the said William Hann and Mary his Wife whereunto they or any or either of them shall be parties or privies shall be and entire? and shall be construed adjudged deemed and taken to be and entire? and is hereby declared to be and entire? unto and to the Use of the said Ann Brickell her Exors Admors and Assigns untill she the said Ann Brickell her Exors Administators and Assigns shall be fully repaid as well the said Sum of Ninety pounds as the said Sum of Thirty pounds making together the Sum of One Hundred and Twenty pounds and all Interest to grow due for the same and from and after payment and Satisfaction of the said respective Sums and Interest for the Same and subject thereto To the several Uses in the said last recited Indenture of Mortgage In Witness whereof the said partys have hereunto set their Hands and Seals the day and Year first above written"
